Plain-English Summary: KinBridge is an AI companion platform for seniors and their families. By using it, you agree to use it responsibly. We are not a medical provider. Your data is yours — you can delete it. Voice cloning requires explicit consent from the person being cloned.

1. Acceptance & Version Updates
By creating an account, accessing, or using KinBridge (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
We may update these Terms from time to time. When we make material changes, we will: (a) update the version number and effective date above; (b) notify registered users by email and in-app banner; and (c) require re-acceptance before continued use if the changes are significant. Your continued use after the effective date constitutes acceptance of the revised Terms.
The current version is 2.0. You can review prior versions in the Version History below.
2. Services Description
KinBridge provides an AI-powered companion platform designed for seniors and their families, including:
- AI Companion — Conversational AI for daily engagement, emotional support, and activity prompting
- Health Monitoring — Integration with wearables (Fitbit, Garmin, Apple Watch via Terra) for health metric tracking
- Heartfelt Moments — AI-curated capture of meaningful conversations and memories
- Last Words (Farewell) — AI-assisted creation of farewell messages and legacy content, including optional voice cloning
- Caregiver Dashboard — Family and caregiver access to companion activity and health summaries
- Enterprise Care — Tools for hospice facilities, care homes, and employer wellness programs
3. Accounts & Eligibility
You must be at least 18 years old to create an account. By registering, you represent that you are legally capable of entering into binding contracts under applicable law.
For enterprise or institutional accounts, the organization administrator accepts these Terms on behalf of the organization and all its users.
You are responsible for maintaining the security of your account credentials. Notify us immediately at privacy@kinbridge.app if you suspect unauthorized access.
4. AI Companion Disclaimer
KinBridge's AI companion is not a human. It uses large language models to generate responses. While designed to be empathetic and helpful, it can make errors, be inconsistent, or produce unexpected outputs.
You acknowledge and agree that:
- The AI companion does not have feelings, opinions, or consciousness
- Conversations are processed by AI systems and stored as described in our Privacy Policy
- The AI companion should not be the sole source of emotional support for individuals in crisis — in emergencies, contact 911 or the 988 Suicide & Crisis Lifeline
- KinBridge is not responsible for decisions made based on AI companion responses
5. Medical & Health Disclaimer
KinBridge is not a medical device, healthcare provider, or medical service. Nothing on this platform constitutes medical advice, diagnosis, or treatment.
Health metrics displayed (heart rate, steps, sleep, etc.) are provided for informational and wellness purposes only. They are sourced from third-party wearables and may not be accurate or complete. Always consult a qualified healthcare professional for medical decisions.
KinBridge does not constitute an emergency response system. In a medical emergency, call 911 or your local emergency number immediately.
For enterprise customers in regulated healthcare environments (hospice, skilled nursing): a signed Business Associate Agreement (BAA) is required before transmitting or storing Protected Health Information (PHI). See our Compliance page.
6. Spiritual & Chaplaincy Guidance Disclaimer
KinBridge may offer AI-generated spiritual companionship, prayer prompts, or chaplaincy-style content for comfort and reflection. This is not a substitute for professional pastoral care, religious counseling, or ordained chaplaincy services.
KinBridge does not endorse any particular religion or spiritual tradition. Spiritual content is personalized based on user-provided preferences and is not intended to make theological claims or influence religious beliefs.
7. Voice Cloning & Last Words (Farewell)
The Last Words and Farewell features allow creation of personalized farewell messages that may include AI-generated voice replication ("voice cloning"). This feature requires:
- Explicit Consent: The explicit, informed, documented consent of the individual whose voice is being cloned — captured via our multi-factor consent flow
- No Impersonation: Voice clones may not be used to impersonate the individual in any context other than the approved farewell project
- Age Restriction: Voice cloning of individuals under 18 is strictly prohibited
- Revocability: Consent may be revoked at any time; upon revocation we delete the voice model
- Third-Party Processing: Voice synthesis uses third-party AI providers — see the sub-processor list
Farewell content is owned by the account holder, subject to revocation. KinBridge retains no right to use farewell content for any purpose other than delivering the service.
8. Biometric Data & BIPA Consent (Illinois Residents)
Illinois Residents: The Biometric Information Privacy Act (BIPA) grants you specific rights regarding voice prints used in voice cloning.
Illinois residents using the Last Words voice cloning feature specifically acknowledge:
- KinBridge collects, stores, and uses your voice print solely to generate personalized farewell audio content
- Voice print data is retained only for the duration of your active account or the farewell project (max 3 years) unless you extend consent
- KinBridge does not sell, lease, trade, or profit from biometric identifiers
- You may request destruction of biometric data at any time via privacy@kinbridge.app
- This consent satisfies BIPA § 15(b)
9. Your Data Rights
You own your data. You have the following rights:
- Access: Request a copy of all personal data we hold about you
- Correction: Request correction of inaccurate data
- Deletion: Request deletion of your account and all associated data
- Portability: Receive your data in a machine-readable format
- Withdrawal of Consent: Withdraw consent for optional processing (voice cloning, health data) at any time
- CCPA (California): Right to know, delete, opt-out of sale, and non-discrimination
- GDPR (EU/EEA): All rights under GDPR Articles 15–22

10. Subscriptions & Payment
KinBridge offers subscription plans (Companion, Family, Care+) billed monthly or annually. By subscribing you authorize recurring charges.

- Annual subscriptions receive a 20% discount and are billed upfront for 12 months
- Cancel anytime; access continues through end of billing period

11. Enterprise Terms
Enterprise customers are subject to additional terms including:
- Business Associate Agreement (BAA): Required for HIPAA-covered entities — request at enterprise@kinbridge.app
- Data Processing Agreement (DPA): Required for EU/EEA data controllers — available on request
- Sub-processor List: Current list at Privacy Policy — Sub-processors
- SLA: Standard uptime target 99.5%; defined in the Master Service Agreement
12. Prohibited Uses
You may not use KinBridge to:
- Deceive, manipulate, or psychologically harm seniors or vulnerable individuals
- Create deepfakes or synthetic media without explicit consent
- Harvest personal data from seniors without their knowledge
- Engage in financial exploitation or elder abuse
- Violate applicable laws including privacy, consumer protection, or healthcare regulations
- Reverse-engineer, scrape, or interfere with the platform
13. Termination & Data Deletion
You may close your account via Settings → Account → Close Account, or by emailing privacy@kinbridge.app.
Upon closure:
- Personal data (messages, health data, profiles) deleted from primary database within 30 days
- Media files (photos, audio, voice models) deleted from file storage within 30 days
- Third-party sub-processors notified to delete associated data per their contractual obligations
- Backups may retain data up to 90 days before being overwritten
- Legally required records (financial, consent audit logs) retained for the required period
14. Limitation of Liability
To the maximum extent permitted by law, KinBridge's liability is limited to amounts paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages. This limitation does not apply to gross negligence, willful misconduct, fraud, or liabilities that cannot be limited by law.
15. Governing Law & Disputes
These Terms are governed by the laws of Delaware, USA. EU/EEA users may use the online dispute resolution platform at ec.europa.eu/consumers/odr.
